How Copyrights are Acquired

  • Registration
    • Works do not need to be registered to be protected by copyright
    • There are incentives to registering
    • With a registered copyright, the owner may sue for statutory damages that do not need proof of actual financial damage
  • Notice
    • Although notice is not required to protect copyrighted works, it is recommended so as to signify that the author has not abandoned the work to the public domain
  • Notice has three elements
    • the letter C in a circle ©, the word copyright or the abreviation copr.
    • the year of first publication
    • the name of the copyright owner
