The Supreme Court had said it is not Constitutional for the government to dictate to publishers and newspapers about what is and is not acceptable to print.

However, broadcasters are not afforded such protection.

Broadcasting is a limited spectrum. The government regulates and licenses this spectrum ("physical property allowing radio ad television signals to be sent from transmitter to receiver" (p. 604)).

The FCC regulates broadcasting.
